1. Scope

These Terms cover https://omnistormgaming.com, its contact channels and voluntary website contributions, operated by OmniStorm Gaming LLC, a Colorado game studio ("we" or "us"). They apply only to the extent a valid agreement is formed under applicable law. Our Privacy Policy explains personal-information use: https://omnistormgaming.com/privacy.

2. Games, assets and stores

The identified product license and the relevant store's terms govern a game or asset purchase and use. These website Terms do not grant, replace or add restrictions to a software or asset license. Our asset packs retain the OmniStorm Gaming Asset License supplied or linked with the product.

The OmniStorm Game License applies only to games and distribution channels that identify it as their license. It excludes Apple App Store and TestFlight copies. App Store copies use Apple's Standard Licensed Application End User License Agreement unless their listing expressly supplies a different license: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. TestFlight has separate beta terms: https://www.apple.com/legal/internet-services/itunes/testflight/sren/terms.html.

Check the product listing and checkout for the seller, price, payment and refund process. Use the relevant store's process for store purchases. Mandatory rights concerning digital content, quality, descriptions, cancellation, refunds and other remedies remain available.

3. Children and communications

Parents should handle children's purchases and support requests, using their own contact details and a brief description without identifying the child. Only adults who have reached their local age of majority and are authorized to use the payment method may make website contributions. Store purchases and beta participation follow their separate eligibility rules. An age rating or agreement to terms does not establish verified parental consent for personal-information collection.

For support, email support@omnistormgaming.com. Do not send private game data or children's identifying information. Messages and attachments remain subject to our Privacy Policy; sending a private file does not make it public or grant permission to use it in advertising or as general feedback.

We do not provide saved-game retrieval or gameplay walkthrough services. Support availability does not promise a particular response time, future feature or update. This does not reduce obligations under a product agreement or applicable law, including consumer remedies and privacy request and complaint deadlines.

4. Voluntary support contributions

Website contributions voluntarily support our work. They do not buy a product, service, special access, ownership interest or promised benefit, or require completion of a project. We are a for-profit business; these payments are not charitable donations and do not qualify for a charitable contribution tax deduction. Other tax treatment depends on your circumstances.

PayPal processes contributions under its terms. Check the amount, currency and frequency before authorizing payment. Recurring contributions require your selection and authorization. Cancel future payments through PayPal's automatic-payment settings or PayPal support. We handle cancellation requests as required by applicable law and PayPal's rules. Do not send passwords or full card details. Cancellation alone does not refund payments already processed.

Contact us or the provider about duplicate, mistaken or unauthorized payments. Applicable cancellation, refund, withdrawal and dispute rights remain available. These Terms do not create an additional refund program.

5. Suggestions and creative work

If an adult deliberately sends non-personal suggestions clearly identified as voluntary product or business feedback, we may use those suggestions to improve the relevant product or service without payment for the suggestion itself. This does not transfer ownership or permit publication of identity or original creative work. It excludes ordinary support, private files, children's submissions and TestFlight information.

We do not accept unsolicited manuscripts, artwork, music, game concepts or other creative work for evaluation or licensing. Sending work without an agreement creates no duty to review, pay for or use it and grants no blanket exploitation license. Do not send confidential business ideas without a separate agreement. Privacy duties still apply to private correspondence.

6. Website content and acceptable use

Our website text, art, branding and other materials are owned by us or used with permission. You may view them and make reasonable personal reference copies, retaining relevant notices. Other use follows the applicable license or permission. Do not claim our work as your own or falsely imply endorsement. Copyright exceptions, criticism, fair use and other legal rights remain.

Use our website and contact channels lawfully. Do not commit fraud, harass others, send malware, infringe rights, access private systems without authorization or deliberately disrupt services. Lawful security research and responsible reports are not prohibited. We may take proportionate steps against misuse; restricting website access does not itself cancel a separate product license.

7. External services

Stores, payment services, social platforms and video providers have their own terms and privacy practices. We do not operate those independent services, but remain responsible for our own conduct and obligations. Embedded YouTube use is subject to https://www.youtube.com/t/terms. Parents should supervise children's use of external services.

8. Website availability and liability

Website information can contain errors or become outdated. Check current product listings before purchase. We may update, interrupt or discontinue website features, with notice where required. This does not automatically change an existing product agreement or remove an outstanding obligation.

For business users only, the website is provided "as is" and "as available," without implied warranties to the extent law permits. A business user acts for a trade, business or profession and must have authority to represent any organization they act for. These website disclaimers do not change a separate product agreement or apply to consumers.

Mandatory consumer rights and remedies remain intact. Nothing excludes liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or liability that cannot lawfully be limited. Subject to those protections, for business users only and where law permits, we exclude lost profits and indirect or consequential losses from website use. Our total liability for that use is limited to the greater of US $100 or your website contributions paid directly to us during the 12 months before the event giving rise to the claim. This does not limit required refunds or liability under a separate product agreement.

9. Disputes

Colorado law governs these Terms without taking away mandatory protections of a consumer's home jurisdiction. Consumers may use courts available under applicable law. Business-only disputes belong in Colorado state or federal courts, subject to mandatory jurisdiction rules.

You may email us about concerns, but need not complete an informal process or wait before exercising a right. Correspondence does not suspend legal deadlines unless law or a separate agreement provides otherwise.

10. Changes and general provisions

We publish changes with an updated date, prospectively unless otherwise lawfully agreed. We give additional notice or obtain agreement when required. Changes do not rewrite completed transactions, accrued rights, existing disputes or separate product agreements. Continued use alone does not replace affirmative agreement where required.

Separate agreements and mandatory law take precedence within their scope. If a provision is invalid, the rest remains effective where lawful; this does not authorize removing consumer protections. A delay in enforcement does not waive a right. Business transfers remain subject to contractual protections, privacy commitments and required notices.
